Binding arbitration notice

These Terms of Service include a binding arbitration agreement on an individual basis. You agree that any disputes will be resolved through individual arbitration and not through jury trials or class or representative actions. Remedies available to you may be limited under this agreement.

Electronic communications

You agree to receive electronic communications from Expert Visa as part of the consulting services we provide, including readiness review updates and preparation checklists. If, at any time, you do not want to receive further communications, please let us know by emailing support@expertvisa.us.

Review of answers & responsibility

You understand that Expert Visa's review of your answers is limited to completeness, spelling, and internal consistency of names, addresses, dates, and similar fields. When you subsequently file a real application on an official U.S. government website, you agree to be solely responsible for the final application(s) and their content.

Accuracy of information

By agreeing to these Terms, to the best of your knowledge you confirm the accuracy and correctness of all information provided to Expert Visa. Expert Visa uses your information solely to prepare consulting deliverables (checklists, answer reviews, interview coaching materials). Expert Visa does not submit any form on your behalf and does not use your digital signature to file with any government agency.

No guarantee of outcome

Approval of any visa, ESTA, or travel-document application is decided solely by the relevant U.S. government authority and is entirely outside Expert Visa's control. Expert Visa does not issue any government document. Expert Visa makes no guarantee, express or implied, regarding the approval, denial, processing time, or appointment availability of any application you may subsequently file.

Non-English-speaking customers

You understand that certain materials on this website, including questionnaires, documents, instructions, and filings, are only available in English. Non-English translations of these Terms and other policies are provided for convenience only. In the event of any ambiguity or conflict between translations, the English version is authoritative.

Limitation of liability and indemnification

Except as prohibited by law, you will hold Expert Visa and its officers, directors, employees, and agents harmless from any indirect, punitive, special, incidental, or consequential damages, however arising (including attorneys' fees and all related costs and expenses of litigation or arbitration), whether in an action of contract, negligence, or other tortious action arising out of or in connection with this agreement. Except as prohibited by law, if there is liability found on the part of Expert Visa, it will be limited to the amount paid for the products and/or services, and under no circumstances will there be consequential or punitive damages.

Third-party services and government fees

When you subsequently file with a U.S. government agency, use a payment processor, or use any other third-party service, you understand that you may be required to accept additional terms located on that third party's website. Expert Visa disclaims liability for any information, materials, products, or services offered by those third parties.

Listed prices for Expert Visa's consulting services are for private consulting only and do NOT include any government application, MRV, biometrics, or other filing fees. Government fees are paid by you directly to the relevant government agency.

Future products and services

If you choose to add a product or service to your order after this initial purchase, these Terms of Service will apply to that additional product or service as well.

Refund policy

Governing law

These Terms and your use of this website shall be governed by and construed in accordance with the laws of the United States and the State in which Expert Visa Service LLC is organized, without giving effect to any principles of choice or conflict of law.

Timing of claims

Any cause of action or claim you may have with respect to this website must be commenced within one (1) year after the claim or cause of action arises.

Arbitration and venue

Any dispute relating in any way to your visit to this website shall be submitted to confidential arbitration in the United States. Arbitration under these Terms shall be conducted under the rules then prevailing of the American Arbitration Association in accordance with its Commercial Arbitration Rules and before a single arbitrator. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. Testimony, evidence, rulings, and all documentation regarding any arbitration shall be considered confidential.

Class action waiver

To the fullest extent permitted by applicable law, no arbitration under these Terms shall be joined to an arbitration involving any other party. You agree to arbitration on an individual basis. NEITHER YOU NOR WE WILL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER USERS IN COURT OR IN ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER, OR IN A PRIVATE ATTORNEY GENERAL CAPACITY.

Suspended accounts

You agree that we have the right, but not the obligation, to monitor, suspend, terminate, edit, disclose, refuse to post, or remove at any time, for any reason in our sole discretion, any material, content, or activity anywhere on this website.

Reviews

After your purchase, you may receive an email survey request from Expert Visa. If you complete the survey or submit a review, your opinions may be posted, in whole or in part, on the website or used in marketing material.

Force majeure

Expert Visa shall not be considered in breach of or default under these Terms for any cessation, interruption, or delay in performance of its obligations by reason of earthquake, flood, fire, storm, natural disaster, act of God, epidemic, pandemic, war, terrorism, armed conflict, labor strike, government shutdown, or similar event beyond our reasonable control.

Right to refuse

You acknowledge that Expert Visa reserves the right to refuse service to anyone, at our sole discretion.

Acknowledgment

You understand that these Terms affect your legal rights and obligations. If you do not agree to be bound by all of these Terms, you should not use this service. By proceeding with your purchase, you agree to these Terms of Service.
